Arizona Strengthens Background Checks for Nursing Facility Workers – Employment Screening Resources

On March 18, 2022, Arizona Governor Doug Ducey signed into law Senate Bill 1242 (SB 1242) to strengthen background checks for people who want to work in state nursing facilities, according to a press release on the Governor’s website that listed all 19 bills signed into law that day by the Governor.

“Our nursing homes and assisted living facilities deserve accountability and leadership from their supervisors,” Governor Ducey said in the news release. “SB 1242 accomplishes this. Our elders – grandmothers, grandfathers and family members – deserve nothing less to keep them safe, happy and healthy.

Sponsored by State Senator Tyler Pace (R-District 25), SB 1242 improves background checks for licensing through nursing and assisted living facilities (NCIAs). Proper vetting of managers and staff at these facilities is critical to the safety of vulnerable seniors housed at NCIA facilities.

In addition to strengthening background checks, the bill bars those convicted of violent crimes or financial fraud from obtaining a license. The NCIA board should work with the Arizona Department of Health Services to establish a process for identifying and referring complaints between agencies.

SB 1242 defines crimes that constitute a “crime involving violence or financial fraud” as forty-six specific offenses that include homicide, sexual assault, sexual abuse, child abuse, neglect of a vulnerable adult, indecent exposure, terrorism, theft, tampering, fraudulent use of a credit card, welfare fraud, kidnapping and robbery.
